1. Scope

These Terms & Conditions apply to all products and services offered by Pyrenees Cycling Guide, including but not limited to:

  • Digital guides (PDF downloads)
  • GPX routes
  • Phone consultations
  • Custom itineraries
  • Gold Service (ongoing trip support)
  • Any other digital or consulting services

These Terms apply to both consumers and business customers. Where mandatory consumer protection law applies, such law shall prevail.

By purchasing a product or service, you agree to these Terms.


2. Payments & Delivery

All payments are processed digitally and must be completed in full before access is granted.

Digital products (PDF guides, GPX files, itineraries) are delivered electronically after successful payment.

Consulting services and Gold Service support are scheduled and delivered after payment confirmation.

No payment plans are offered.


3. Right of Withdrawal (Digital Products – EU Consumers)

For digital products that are delivered immediately after purchase:

By completing the purchase, the customer:

  • Explicitly requests immediate delivery, and
  • Acknowledges that the statutory 14-day right of withdrawal is waived once the download or access has started.

If access has not yet been granted, the statutory right of withdrawal remains applicable in accordance with EU and Dutch consumer law.

This provision does not affect the voluntary 100% Satisfaction Guarantee described below.


4. 100% Satisfaction Guarantee (14 Days)

Your satisfaction matters.

If you are not satisfied with your purchase, you may request a refund within 14 days of purchase.

Before a refund is granted:

  • You must explain in writing what did not meet your expectations.
  • Pyrenees Cycling Guide must be given a reasonable opportunity to correct or improve the issue.

The intention of this guarantee is fairness — not free use.

Abuse Protection

The guarantee may be refused in cases of clear misuse, including but not limited to:

  • Requesting a refund after full use of the product without raising concerns earlier.
  • Requesting a refund after extensive implementation of a custom itinerary beyond the agreed revision process.
  • Requesting a refund after completion of all three itinerary versions and final revision.
  • Repeated refund requests by the same customer.
  • Evidence of copying, sharing, or redistributing materials.

Refund decisions are made reasonably and in good faith by Pyrenees Cycling Guide.


5. Custom Itineraries – Specific Conditions

A custom itinerary is a personalized consulting service delivered digitally.

The process includes:

  1. A detailed intake consultation
  2. First version delivery
  3. Second revision after feedback
  4. Final small revisions

Refunds are possible within 14 days, particularly during the early consultation phase.

However, once:

  • The consultation has taken place,
  • The itinerary has been delivered and revised multiple times, and
  • The final revision has been completed,

a refund request may be refused if the service has been fully and reasonably delivered.

This ensures fairness and prevents misuse of extensive custom work.

Constructive feedback remains welcome at all times.


6. Intellectual Property

All content provided by Pyrenees Cycling Guide — including guides, GPX routes, itineraries, texts, and materials — remains the intellectual property of Pyrenees Cycling Guide.

All rights reserved.

These materials are licensed for personal use only. They may not be copied, shared, resold, reproduced, translated, adapted, published, distributed, or used for commercial purposes, in whole or in part, without prior written permission.

Purchasing a product grants you the right to use it — not to redistribute it.


7. Liability & Responsibility

Cycling in mountain environments involves inherent risks.

By purchasing and using any product or service, you acknowledge that:

  • You are fully responsible for your own safety.
  • You must assess your own fitness, skills, and preparation.
  • Weather, road conditions, and local circumstances can change without notice.
  • You are responsible for checking current conditions before riding.
  • You are responsible for equipment, insurance, and compliance with local laws.

All information is provided in good faith and based on experience.

Limitation of Liability

To the extent permitted by law:

  • Pyrenees Cycling Guide is not liable for indirect or consequential damages.
  • Any liability is limited to the amount paid by the customer for the relevant product or service.
  • Nothing in these Terms excludes liability for intent (opzet) or gross negligence (grove schuld), where such exclusion is not legally permitted.

Pyrenees Cycling Guide is not responsible for third-party services such as accommodation providers, transport providers, restaurants, or local authorities.

Use of all routes, advice, and materials is entirely at your own risk.


8. Gold Service & Consulting

Gold Service and consulting provide guidance and support, not supervision or on-site responsibility.

All decisions during your trip remain your own.

No guarantee is given regarding outcomes, weather, availability, or third-party performance.


9. Force Majeure

Pyrenees Cycling Guide is not liable for delays or inability to perform services due to circumstances beyond reasonable control, including but not limited to illness, extreme weather, travel restrictions, technical failures, or government measures.


10. Privacy & Data Protection

Pyrenees Cycling Guide processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).

By purchasing a product or service, you acknowledge that you have read and accepted the Privacy Policy.


11. Modification of Terms

Pyrenees Cycling Guide reserves the right to modify these Terms & Conditions.

The version applicable to a purchase is the version in force at the time of that purchase.


12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


13. Governing Law

All agreements are governed exclusively by Dutch law.

Any disputes shall be submitted to the competent court in the Netherlands.
